The following terms and conditions apply to all transactions on www.danibergson.com
These terms constitute a legal document (“the Agreement”), and sets out the rights and obligations the Purchaser (“you”, “the Purchaser”), and those of Dani Bergson (“The Company”), in relation to the services and products offered by us through this site.
Agreements are made and orders/purchases accepted only upon and subject to these terms and conditions of business. All other terms are hereby excluded unless expressly accepted in writing by the Company.
It is a requirement that you accept these Terms and Conditions when placing an order.
Acceptance of orders
Any electronic acknowledgement provided by us of an order does not constitute legal acceptance by us of your order.
The contract of sale is created at the point of despatch of your goods.
Goods will be supplied at their correct prevailing prices and descriptions. Should this differ from the price/description shown on the site we will give you the right to reject the goods within a reasonable time period for a full refund.
It is the responsibility of the Purchaser to determine the suitability of the goods for any application. We do not guarantee the suitability of the goods for any specific purpose from any description displayed or verbal advice given by a Company employee and we make no representation that any product referred to on the danibergson.com website is available to purchase.
Liability for breach of any warranty or obligation either expressed or implied is limited to the value of the goods supplied.
Title
Goods shall be at the risk of the customer as soon as they are delivered by the Company to the customer’s vehicles or its premises or otherwise to its order. Goods shall remain the sole and absolute property of the Company as legal and equitable owner until such time as the customer shall have paid to the Company the full price for the goods.
Deliveries
Every effort will be made to deliver goods as purchased however the Company cannot accept responsibility for delays due to circumstances beyond its control and accepts no liability whatsoever for any loss arising from any failure to supply under any circumstances. The customer must use reasonable endeavours to accept delivery in accordance with any agreed delivery arrangements and if requested assist with the unloading of any delivery.
Orders received between Monday and Friday are normally despatched within one working day but please allow 5 days for delivery.
Claims, returns and cancellations
Delivery Claims:
All goods must be checked upon receipt. Any damage must be indicated on the delivery note at the time of delivery.
Goods must be checked against the delivery note and You must notify the Company of any damages or discrepancies within 3 working days of delivery.
Credit may not be given for goods returned without prior agreement from the Company. The Company reserves the right to recover carriage and handling costs where unauthorised returns are made.
No claims will be entertained unless the above conditions are strictly adhered to.
The records of the Company shall be conclusive as to deliveries to and purchases by the customer.
Cancelling an Order:
Subject to the right of Purchasers to return goods for a refund under The Supply of Goods and Services Act and Distance Selling Regulations, we do not sell products to try. Customers are strongly recommended to check suitability and specifications of products before ordering.
UK customers have a legal right to cancel their order from the point of placing the order until 7 working days after the day the goods are received and receive a full refund. Please contact us first before returning any goods.

Please provide your name, order reference, contact number and your address and postcode in any communication.
If you decide to cancel your order after the goods have been despatched you will need to ensure that the following requirements are met in full and you will also be responsible for returning the goods to Dani Bergson at your own risk and cost and we recommend that you use an insured delivery method e.g. Royal Mail Special Delivery.
Except where goods are faulty, or incorrectly described on the website, ALL returns are subject to the following conditions:
- Sealed Packaging – If the product is provided in sealed packaging such packaging must be intact, unopened and unmarked for us to accept your return.
- It must also be returned complete with any accessories in the original and undamaged outer packaging and not exhibiting any signs of wear or tear.
- Any use of the purchased item beyond that necessary to VIEW the goods (unused) will invalidate your right to cancel the contract.
- Any free gifts supplied with the product must also be returned.
- Goods cancelled outside the 7 day period (but within 14 days of receipt) which cannot be re-sold as new may be subject to a restocking charge. Goods cannot be cancelled after this 14 day period.
- Monies will be refunded within 30 days of the cancellation date. In the case of credit or debit cards, this will be to the card used to make the purchase.
Faulty or incorrectly described goods
All goods offered by the Company are guaranteed to meet UK statutory requirements. However, the Company cannot accept responsibility where goods supplied are subject to further processing or re-packing by the customer.
If the fault occurs within 30 days of delivery you will have the option of a refund or exchange. This does not cover faults caused by accident, neglect, misuse or normal wear and tear. It will help us to process your return if the goods are complete with the original packaging and supplied accessories. No refund will be processed until the faulty goods have been received and inspected by ourselves.
If the fault occurs after 30 days but within 12 months of delivery we will offer replacement only. In all cases we reserve the right to inspect the product and verify the fault but if no fault is found, return the goods to you.
This returns policy does not affect your statutory rights, details of which are available from Consumer Direct or your local Citizens Advice Bureau.
Purchasers resident outside the UK will be responsible for returning the goods at their own risk and cost during any of the above periods. Otherwise the same criteria apply.

The company reserves the right to amend these terms from time to time by updating this page. Orders placed will be in accordance with the terms agreed at the time of purchase.
